Welcome to CuidarConAmor.

These Terms of Use govern access to and use of the application, the website and the services offered under the CuidarConAmor brand.

By creating an account and expressly accepting these Terms, you enter into an agreement with CuidarConAmor to use the service under the conditions described here.

We recommend reading them before creating your account.

1. What CuidarConAmor is

CuidarConAmor is a technology tool for organization and support, intended for people caring for someone living with Alzheimer's or another form of dementia.

Among other features, CuidarConAmor may allow you to:

• record medications, doses and schedules;
• create reminders;
• record routines and activities;
• save observations relating to care;
• carry out tracking;
• preserve memories and biographical information;
• share information with other people within a care circle;
• consult educational content;
• receive general guidance through artificial intelligence tools.

The available features may vary according to the version of the application and the plan contracted.

2. CuidarConAmor is not a medical service

CuidarConAmor is not a healthcare provider and does not replace care by doctors, nurses, psychologists or other healthcare professionals.

The application does not make medical diagnoses and does not prescribe medications or treatments.

Educational content, general recommendations, questionnaires, scales, summaries and responses generated through artificial intelligence are intended to be informative, educational and supportive of care.

Although certain content may have been produced or reviewed with the support of healthcare professionals, it does not constitute an individual clinical assessment and does not replace the judgement of a professional who personally knows the health condition of the person being cared for.

3. Requirements for creating an account

To create and use an account you must:

• be at least eighteen (18) years old;
• provide reasonably truthful and up-to-date information;
• use an account you have legitimate access to;
• keep your credentials protected;
• comply with these Terms of Use.

You are responsible for activities carried out from your account where they are attributable to the use of your credentials.

If you detect unauthorized access, you must inform us as soon as possible [email protected].

4. Information about other people

CuidarConAmor allows a person to record information relating to someone they care for.

Being a relative, friend or caregiver does not automatically grant unlimited authorization to record, use or share another person's personal data.

By recording information belonging to another person, you declare that you have the authorization, representation or standing required by applicable law.

The processing of personal data and sensitive data is further governed by our Privacy Policy and Personal Data Processing Policy and by any specific authorizations that may apply.

5. Care circle

CuidarConAmor allows circles to be created in order to share and coordinate information relating to a person being cared for.

Each circle corresponds to one person being cared for and may currently include up to six (6) members.

The person who creates the circle may administer it, including functions such as inviting members and withdrawing access, in accordance with the available features.

One subscription covers the corresponding circle and does not require each member to contract an individual subscription in order to take part in it.

Codes, links or other invitation mechanisms may grant access to private information and, potentially, to sensitive health-related data.

For this reason you must:

• share them only with authorized people;
• use private channels to send them;
• avoid publishing them on social media, public sites or open groups;
• withdraw access when a person should no longer be part of the circle.

Each member is responsible for the use they make of the information they legitimately have access to.

6. Free trial period

Eligible new users may access a free period of fourteen (14) days, subject to the conditions in force at the time of registration.

A payment method is currently not required to start this free period.

Therefore, at the end of the fourteen days no charge will be made automatically if the user has not expressly contracted a subscription.

CuidarConAmor may in future modify the conditions of promotions or free periods for new users, clearly stating the applicable conditions before they are activated.

7. Subscriptions and prices

After the free period, the user may contract a subscription.

The following are currently offered:

• Monthly plan: $19.900 COP
• Yearly plan: $179.000 COP

Prices are stated in Colombian pesos and will be shown to the user before payment is made.

Before confirming a purchase, the applicable information on price, contracted period and other relevant conditions will be displayed.

The subscription covers the features enabled for the corresponding circle according to the plan contracted.

Payment will be processed through the mechanisms enabled by CuidarConAmor.

The subscription will only be activated once the corresponding payment has been confirmed.

8. Renewals

If at the time of launch subscriptions require a new manual payment at the end of each period, there will be no automatic renewal or charge.

If CuidarConAmor introduces automatic renewal in future, the user will be clearly informed before contracting it about how it works, its frequency, price, charging mechanism and how to cancel it.

No automatic renewal will be carried out based solely on the user's silence or inactivity.

9. Cancellation

You may cancel your subscription using the mechanisms available in the application or by contacting us.

Cancellation will prevent renewal of the subscription where applicable, but you may continue using the paid features until the end of the period you have already contracted, unless another remedy applies by law.

We do not charge penalties for cancelling a subscription.

10. Right of withdrawal and other consumer rights

Where the right of withdrawal provided for by Colombian law applies, the consumer may exercise it within the period and under the conditions established by law.

You may request it by writing to [email protected].

The request must include the information reasonably necessary to identify the buyer and the transaction.

Where withdrawal is legally appropriate, we will make the corresponding refund within the period established by applicable law and through one of the permitted mechanisms.

Nothing in these Terms limits the non-waivable rights that may correspond to consumers.

11. What happens when a subscription ends

When a subscription ends, CuidarConAmor may limit certain features that require an active subscription.

The end of a subscription does not necessarily mean the immediate deletion of previously recorded information.

While CuidarConAmor keeps this arrangement in place, the user may retain read access to certain previously created records.

The features available without an active subscription may change in future. If we make a substantial change affecting previously stored information, we will seek to give reasonable advance notice where appropriate.

Retention and deletion of personal data are governed by ourPrivacy Policy and Personal Data Processing Policy.

12. Artificial intelligence

Some CuidarConAmor features may use artificial intelligence to generate guidance or information at the user's request.

Artificial intelligence responses may contain errors, incomplete information or interpretations that are not appropriate for a particular situation.

For this reason, you must not use a response generated by artificial intelligence as a substitute for a diagnosis, prescription, clinical assessment or professional decision.

When a decision may affect a person's health or safety, it must be discussed with a competent healthcare professional.

The processing of information needed to offer these features is described in our Privacy Policy and Personal Data Processing Policy.

13. Acceptable use

CuidarConAmor must be used lawfully and with respect for the rights of other people.

You may not:

• deliberately record information about other people without the required authorization or standing;
• access or attempt to access circles, accounts or information you are not authorized to access;
• publicly share private codes or invitation mechanisms;
• obtain information through techniques designed to circumvent our security controls;
• introduce malware, malicious code or mechanisms designed to affect the operation of the service;
• use the service for fraudulent or unlawful activities;
• deliberately interfere with the service's infrastructure;
• use automated mechanisms to extract information from the service in bulk without authorization;
• sell, sublicense or resell access to CuidarConAmor without authorization;
• impersonate another person;
• use CuidarConAmor in a way that infringes third-party rights.

14. Content entered by users

Users retain the rights legally due to them over the content they add to CuidarConAmor.

By entering content, you grant CuidarConAmor the authorizations strictly necessary to store, process, technically reproduce and display it for the sole purpose of operating and providing the service's features, in accordance with these Terms and our Privacy Policy.

This authorization does not allow us to sell your content or to use health information for advertising.

When you enter content belonging to third parties, you must have the necessary authorizations or rights to do so.

15. CuidarConAmor's intellectual property

Except for content belonging to users or third parties, the original elements of CuidarConAmor, including software, text, educational material, graphic elements, structure, design and other protectable content, belong to CuidarConAmor or are used under the corresponding authorizations.

Use of CuidarConAmor does not transfer any intellectual property rights over these elements to the user.

You may use the content only within the limits permitted by these Terms and applicable law.

You may not copy, commercially exploit, distribute or modify protected CuidarConAmor content beyond the uses permitted by law without prior authorization.

16. Service availability

We work to keep CuidarConAmor available and functioning properly.

However, temporary interruptions may occur due to maintenance, updates, infrastructure problems, technology provider failures, connectivity, force majeure or other circumstances.

Where reasonably possible, we will seek to reduce the impact of scheduled interruptions.

CuidarConAmor must not be used as the only mechanism to remember or administer a medication, handle an emergency or carry out any activity whose omission could pose an immediate risk to a person's health or safety.

17. Liability

CuidarConAmor will provide the service in accordance with these Terms and with the obligations established by applicable law.

The user is responsible for the decisions they make regarding another person's care and must seek professional guidance where appropriate.

CuidarConAmor will not be liable for consequences arising from incorrect information entered by users themselves, from use of the service for purposes other than those for which it was designed, or from actions by third parties that are not legally attributable to CuidarConAmor.

Technology tools, including artificial intelligence systems, may present errors or interruptions, and their information must therefore be interpreted taking into account the warnings set out in these Terms.

Nothing in these Terms excludes, restricts or limits liabilities legally attributable to CuidarConAmor, nor the non-waivable rights recognized to consumers.

18. Account suspension

We may temporarily suspend an account where there is an objective reason relating to:

• breach of these Terms;
• fraudulent activity;
• risks to the security of the service;
• attempted unauthorized access;
• unlawful use of the platform;
• the need to protect the rights or information of other users.

Where reasonably possible and where there is no immediate risk to security or to third parties, we will inform the user of the situation and give them the opportunity to correct it.

The measures adopted must be proportionate to the nature of the breach.

19. Account closure

You may request closure of your account through the features available in CuidarConAmor or by writing to [email protected].

Closing an account and deleting personal data may have different effects and procedures.

Requests relating to deletion, removal or retention of personal data will be handled in accordance with our Privacy Policy and Personal Data Processing Policy and applicable law.

20. Changes to the service

CuidarConAmor may add, modify or withdraw features in order to improve, maintain or adapt the service.

We will not use this power to arbitrarily remove rights acquired by a consumer in respect of a period already paid for.

Where a change substantially affects the essential characteristics of a contracted service, the user will be informed where appropriate and the rights recognized by applicable law will be respected.

21. Price changes

We may modify subscription prices.

Changes will be communicated before the user makes a new purchase or renewal, and will not retroactively modify the price corresponding to a period already paid for.

22. Changes to these Terms

We may update these Terms when our features, service model or the applicable rules change.

The current version will be available on our website and will show the date of its last update.

Where a change is substantial and affects an ongoing contractual relationship, we will communicate it by a reasonable means and, where legally necessary, request a new acceptance.

23. Personal data protection

The processing of personal data carried out through CuidarConAmor is governed by our Privacy Policy and Personal Data Processing Policy.

Acceptance of these Terms does not replace the specific authorizations for processing personal data or sensitive data where these are required by applicable law.

24. Applicable law and consumer rights

These Terms will be interpreted in accordance with the laws of the Republic of Colombia.

This does not limit the mandatory rights that may correspond to a consumer under the applicable law.

No provision of these Terms is intended to exclude rights that cannot legally be waived.
